A prenup is short for prenuptial agreement. It is a legal contract two people sign before they get married that explains how money, property, debt, and sometimes support will be handled if the marriage ends in divorce, separation, or death. Cornell’s legal dictionary describes it as a premarital contract setting terms for separation. In plain English, a prenup can say things like: “This house/business/bank account stays mine.” “Debt I had before marriage stays my responsibility.” “If we divorce, this is how property will be divided.” “This is how spousal support/alimony will or will not work.” “Assets for children from a prior relationship stay protected.” Prenups usually focus on financial issues, not day-to-day relationship rules. The American Bar Association notes that prenups commonly address spousal support and property division, and can also help protect a business, inheritance, estate plan, or assets for children from a prior relationship. A prenup generally cannot decide child custody or child support in advance. Courts usually keep control over issues affecting children because the standard is the child’s best interest and the child’s right to support. Without a prenup, the couple is basically leaving those financial decisions to state law and a judge if they divorce. The ABA explains that when people marry without a prenup, the law of the state where they live will determine issues like property division and support at divorce. Since you were just asking about Georgia: Georgia calls these antenuptial agreements in its statute. In Georgia, the agreement must be in writing, signed by both parties, and attested by at least two witnesses, one of whom must be a notary public. Georgia courts also look at whether the agreement was obtained through fraud, duress, mistake, misrepresentation, or nondisclosure; whether it is unconscionable; and whether changed circumstances make enforcement unfair.
